This appeal arises out of a district court order authorizing the commissioner of finance to issue checks and process funds necessary to continue core functions of the executive branch after the legislature ended its regular session in May 2005 without funding many executive-branch agencies for the 2005-07 biennium. The temporary funding order expired on July 14, 2005, when the governor signed a bill funding base-level operations for previously unfunded government agencies, provided that the appropriations were retroactive to July 1, 2005, and expressly superseded the district courts appropriations. More than a month later, a bipartisan group of thirty-two legislators brought this quo warrantor action challenging the constitutionality of the commissioners disbursement of funds without a legislative appropriation. The district court denied the petition, and the group of legislators appeals.
